Damsik,SH.,MH.,CIL seorang Advokat/Penasihat hukum merasakan betul manfaat dari keterangan saksi ahli dari kasus sengketa perdata antar dua Yayasan di Jakarta Barat yang ditanganinya.
“Dari awal kami sudah menentukan bahwa dari kasus ini sangat dibutuhkan keterangan ahli yang memiliki latar keilmuan segala hal tentang Yayasan terlebih dalam kasus ini ada menyangkut sebuah objek berupa bangunan yang disengketakan oleh dua Yayasan,” terangnya.
Selanjutkan Damsik menjelaskan dalam persidangan,sebelum kami mengajukan saksi ahli, Majelis Hakim memutuskan tidak memerlukan Persidangan Setempat (PS) pada objek yang disengketakan. Saat kami menghadirkan Saksi ahli yaitu saudara Indra Iswara, SH., M.Kn kami sebagai kuasa hukum penggugat menanyakan perihal adanya izin domisili palsu yayasan dari tergugat.
“Kami dari penggugat bertanya kepada ahli pak Indra Iswara, apakah ketika terdapat izin domisili palsu atas sebuah yayasan yang telah memiliki kekuatan hukum tetap dapat dibatalkan?, Jawaban ahli, bila terdapat suatu keterangan palsu berupa keterangan domisili maka itu CACAT HUKUM DAN DAPAT DIBATALKAN.” Tegas Damsik.
Atas dasar inilah Majelis Hakim memutuskan memerlukan dilaksanakan Persidangan Setempat. “Setelah mendengar keterangan ahli, Hakim menilai adanya sengketa objek berupa bangunan, dan harus dilaksanakan PS,” ungkap Damsik.
Persidangan Setempat dilaksanakan pada Senin (2/8/2021) di objek yang disengketakan di bilangan Kedoya Jakarta Barat. Seluruh unsur persidangan hadir bersama pihak Penggugat dan tergugat juga para wakil dari kedua yayasan yang bersengketa.
Dalam pembukaan sidang Ketua Majelis Hakim mengatakan bahwa persidangan setempat bukan sidang untuk suatu keputusan. Sidang ini dilaksanakan guna pengumpulan bukti-bukti terkait objek yang disengketakan.
“Jadi mohon untuk menjawab apa yang kami majelis hakim tanyakan, tidak ada jawaban berupa bantahan dan argumen dari para pihak baik penggugat maupun tergugat,” ucap Ketua Majelis Hakim dari Pengadilan Negeri Jakarta Barat yang memimpin Persidangan Setempat.
Sesaat setelah Persidangan Setempat berakhir, Damsik mengatakan bahwa Keterangan ahli menguatkan dalil kami dalam petitum (tuntutan/permintaan apa saja yang dimintakan oleh penggugat kepada Hakim untuk dikabulkan).
